    • The processing of your personal data for direct marketing, Fraud prevention, transmission within the Business Group and data transmissions to ensure network security will be based on the legitimate interest of LATAM Cargo, ensuring the weighting process and considering your rights and liberties.
  11. WITH WHOM DO WE SHARE YOUR DATA?

      • Airports, Government Authorities, Force Bodies and Security Brigades, in compliance with the express request made to all airlines by virtue of control and protection of public safety;
      • Travel agents or other companies through which you make flight reservations with LATAM; and
      • Credit and debit card companies.

    This sharing of personal data is restricted to the minimum necessary, including with respect to suppliers, for proper compliance with legal obligations and/or the aforementioned purposes. These third-party suppliers will not process your data for their own purposes, which have not been previously informed by LATAM Cargo.

    LATAM Cargo is a company that operates in various countries, so it may be that your personal data is processed in a country other than the one in which you are located.

    • 1. If you reside or are in Brazil at the time your personal data is collected, you have the following rights:
      • Revoke the consents granted;
      • Obtain confirmation if LATAM Cargo processes personal data that relates to the User or not;
      • Access your personal data;
      • Rectify inaccurate or incomplete personal data;
      • Request the exclusion of your personal data when, among other reasons, the data is no longer necessary for the purposes for which it was collected;
      • Obtain from LATAM Cargo the limitation of the processing of personal data when any of the conditions set forth in the personal data protection regulations are met;
      • Request the portability of the personal data provided by the user in an active and unconscious manner, as well as the observed data provided by the user by virtue of the use of the service.
      • Submit a claim regarding the protection of your personal data before the National Data Protection Authority (ANPD), when the interested party considers that LATAM Cargo violated the rights guaranteed to him by the applicable regulations on personal data protection.

  20. ANNEX COLOMBIA

    Update: Update the Personal Data that rests in the Databases to maintain its integrity and veracity

    Knowledge and Access: Request proof of the Authorization granted, unless the Law indicates that said Authorization is not necessary or that it has been validated in accordance with the provisions of article 10 of Decree 1377 (article 2.2.2.25.2.7 of Decree 1074 of 2015).

    Rectification: Rectify the information and Personal Data that are under the control of LATAM.

    Revocation: Request the revocation of the Authorization, when the Treatment does not respect the constitutional and legal principles, rights and guarantees. The revocation will proceed when the Superintendence of Industry and Commerce has determined that in the Treatment, the person in charge or in charge of the same has incurred in conduct contrary to this law and the Constitution.

    Request: Submit requests to LATAM or the Treatment Manager regarding the use that they have given to your Personal Data.

    Deletion: Request the deletion of your Personal Data from the LATAM Databases, when the Treatment does not respect the constitutional and legal principles, rights and guarantees. The revocation and/or deletion will proceed when the Superintendence of Industry and Commerce has determined that in the Treatment the Responsible or Processor has incurred in conduct contrary to this law and the Constitution.

    Procedure for inquiries, rectifications and claims regarding personal data

    The actions that may be filed by the Holders, their successors in title, legal representatives and/or third parties duly authorized by the Holders or by law (hereinafter, the "Holders") in relation to queries, rectifications and claims that are related to the personal data registered in the LATAM Databases:

  22. An "inquiry" shall be understood as any request made by the Holders in relation to personal information contained in the individual record or that is linked to the identification of the Holder that rests in any database for which LATAM is responsible

    • El Titular o sus causahabientes que quieran realizar cualquier solicitud en relación con información personal del Titular que repose en cualquier base de datos cuyo responsable sea LATAM, podrá presentar una consulta ante LATAM, así:
    • La consulta se formulará mediante solicitud dirigida a la dependencia encargada para la protección de Datos de LATAM, en este caso, la Dirección Legal de LATAM, al correo electrónico grp_habeasdata@latam.com, de acuerdo a lo establecido en el Numeral 12 de la Política de Tratamiento de Datos Personales.
    • Las consultas y solicitudes de los Titulares serán atendidas en un término máximo de diez (10) días hábiles contados a partir de la fecha de recibo de la misma, en los canales de atención dispuestos expresamente para el efecto por parte de LATAM.
    • Cuando no fuere posible atender la consulta dentro de dicho término, se informará al interesado en la dirección de notificación que haya incluido en la respectiva consulta, expresando los motivos de la demora y señalando la fecha en que se atenderá su consulta, la cual en ningún caso podrá superar los cinco (5) días hábiles siguientes al vencimiento del primer término.
    • La respuesta a las consultas que los Titulares o sus causahabientes presenten podrá ser entregada por cualquier medio físico o electrónico.
  23. Rectifications and claims

    • The Holder or his successors in title who consider that the information contained in the LATAM Databases must be corrected, updated or deleted, or when they notice the alleged breach of any of the duties contained in the law, may file a claim with LATAM So:
    • The claim will be made by request addressed to the agency in charge of data protection of LATAM to the email address grp_habeasdata@latam.com, in accordance with the provisions of Number 12 of the Personal Data Processing Policy.
    • In the event that the person receiving the claim is not competent to resolve it, they will notify the LATAM Legal Department, to the email grp_habeasdata@latam.com within a maximum term of two (2) business days.
    • In the request, the Holder must provide: name and identification number of the Holder, the description of the facts that give rise to the claim, physical and electronic address of notifications, and other documents that are wanted to be asserted to support the claim.
    • If the claim is incomplete, the interested party will be required within five (5) days following receipt of the claim to correct the failures.
    • After two (2) months from the date of the request, without the applicant submitting the required information, it will be understood that he has withdrawn the claim.
    • Once the complete claim is received, a legend that says "claim in process" and the reason for it will be included in the rectifications and claims database, within a term of no more than two (2) business days. Said legend must be maintained until the claim is decided.
    • The maximum term to resolve the claim will be fifteen (15) business days from the day following the date of receipt.
    • When it is not possible to address the claim within said term, the interested party will be informed of the reasons for the delay and the date on which their claim will be addressed, which in no case may exceed eight (8) business days following the expiration of the first term.
    • The response to the rectifications or claims that the Holders present may be delivered by any physical or electronic means.
  24. Revocation of authorization

  25. The Holders of the Personal Data may revoke the consent to the processing of their Personal Data at any time, as long as it is not prevented by any legal or contractual provision. For this, the Holder must follow the same procedure established for Rectifications and Claims.

    It should be taken into account that there are two modalities in which the revocation of consent can be given: (i) It can be for all the consented purposes, in this sense LATAM and/or the Treatment Managers must completely stop processing the data of the Holder and, (ii) can occur on certain types of treatment.

    Due to the foregoing, it will be necessary for the owner, when submitting the revocation request, to indicate in it whether the revocation that he intends to carry out is total or partial. In the second case, it must be indicated which Treatment the Holder is not satisfied with. In the event that the Holder does not indicate it clearly, it will be understood that the request is complete.

    The mechanisms or procedure that LATAM establishes to deal with revocation requests may not exceed the deadlines set to deal with claims as indicated in article 15 of Law 1581 of 2013.

    The request to delete the information and the revocation of the authorization will not proceed when the Owner has a legal or contractual duty to remain in the database.

  26. Processability requirement

  27. In accordance with current regulations, the Holder or successor in title may only file a complaint with the Superintendence of Industry and Commerce once the consultation, claim or revocation of the authorization process has been exhausted before the area in charge, in accordance with the provisions of the Number 12 of the Personal Data Treatment Policy.
